By accessing or using our Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

Account Creation
- Provide accurate, current, and complete information
- You must be at least 18 years old to register
- Keep your account credentials confidential
- Direct competitors may register only with our prior written permission
Account Security
- You are responsible for all activity under your account
- Notify us immediately of any unauthorized use
- We may suspend or terminate accounts that violate these Terms
Permitted Use
- Lawful business purposes
- Marketing activities that comply with applicable laws
- Activities that do not infringe third-party rights
Prohibited Activities
- Any illegal purpose
- Attempting unauthorized access to our systems
- Uploading malicious code or interfering with the Services
- Placing an unreasonable burden on our infrastructure

Fees & Billing
- Fees are quoted in the currency shown at checkout
- Payment is required in advance for the selected Services
- Recurring services are billed automatically each period
- We may change pricing with at least 30 days' notice
Refunds
- Custom projects are paid by stage at a fixed price; stages not yet started are refundable in full
- A delivered stage that doesn't match the approved brief after the included revision rounds is refunded under our Money-Back Guarantee; accepted stages are covered by the 12-month warranty instead
- Ready-made digital products and subscriptions can be refunded in full within 90 days of purchase

Our Rights
- We retain all rights to our Services, technology, and content
- Our trademarks and branding may not be used without written permission
- Source code and files of your custom project are handed over to you in full; our pre-existing tools and libraries remain ours and are licensed to you for use in the project
Your Rights
- You retain ownership of your content and data
- You grant us a license to use your content only as needed to deliver the Services
- You are responsible for having the rights to any content you provide
Privacy & Data Protection
We collect and process data as described in our Privacy Policy. Where your projects involve end users, you remain accountable for obtaining any consents required from them. We apply reasonable safeguards to protect your data, and you remain accountable for keeping your account credentials secure.
Availability & Support
We use commercially reasonable efforts to keep the Services available and to announce scheduled maintenance in advance. We are not liable for downtime caused by factors beyond our reasonable control. Support is provided during business hours; response times depend on issue severity and your service level, and premium support may be available for an additional fee.
Termination by You
- You may terminate with 30 days' written notice
- You remain responsible for fees incurred up to the termination date
Termination by AWDS
- We may suspend access immediately for violations of these Terms
- We may terminate with 30 days' notice for any reason
- We may discontinue any feature of the Services upon notice
Disclaimers & Limitation of Liability
The Services are provided "as is" and "as available" without warranties of any kind. We do not guarantee specific results from using the Services, and we are not liable for any indirect, incidental, or consequential damages.
To the extent permitted by law, our total liability is limited to the amount you paid for the Services in the 12 months preceding the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
Indemnification
You agree to indemnify and hold harmless AWDS and its officers, employees, and agents from any claims, damages, losses, and reasonable costs arising from your use of the Services, your violation of these Terms, or your violation of any third-party rights.
Governing Law & Jurisdiction
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles. Any disputes will be resolved in the courts located in the State of Florida, and you consent to their jurisdiction.
Changes to These Terms
We may update these Terms from time to time. Changes take effect when posted on this page, and material changes will be announced in advance. Your continued use of the Services after changes take effect constitutes acceptance. Last updated: March 2026
